Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the ISMNS platform (the “Service”), operated by ISMNS, located at 5830 E 2nd St, Ste 7000, Casper, WY 82609, USA. By creating an account, accessing an assessment link, or otherwise using the Service, you agree to be bound by these Terms.

1. Description of Service

ISMNS is an online candidate assessment platform. Recruiters can create skills assessments and AI interviews from a job description, share unique assessment links with candidates, and receive structured AI-generated reports including scores, CV analysis, and a hiring recommendation.

2. Account Registration

You must provide accurate and complete information when creating an account. You are responsible for maintaining the confidentiality of your credentials and for all activities that occur under your account. Notify us immediately at support@ismns.com if you suspect unauthorized use of your account.

3. Pricing and Payment

ISMNS uses a pay-as-you-go pricing model. There are no monthly subscriptions or recurring fees.

  • You purchase candidate packs per assessment.
  • Prices are displayed in US Dollars ($).
  • Payments are processed securely through Stripe. We do not store your credit card information.
  • All prices are subject to change. Current prices are always displayed before purchase.

4. Refund Policy

Each candidate assessment slot consumes AI processing resources (including large language model API calls) at the time a candidate begins the test. These costs are incurred immediately and are irreversible. By purchasing a candidate pack, you acknowledge and agree to the following:

  • •Unused packs: A refund may be requested within 7 days of purchase, provided that zero candidates have started the assessment. Contact support@ismns.com.
  • •Once a candidate starts: As soon as any candidate begins the assessment (Skills Test or AI Interview), the corresponding slot is considered consumed. No refund or credit will be issued for consumed slots, regardless of the number of remaining slots in the pack.
  • •Partially or fully used packs: No refunds, no pro-rata credits. Unused slots within a pack remain available for use but are not refundable.
  • •Technical issues: If a technical issue on our side prevents a candidate from completing their assessment, we will replace the affected slot at no extra cost. Refunds are not issued for technical issues; replacements are provided instead.

By completing a purchase, you expressly agree that the digital service begins immediately upon a candidate accessing the assessment, and you waive any right to a refund for consumed slots.

Eligible refund requests are processed within 5–10 business days. Email support@ismns.com with your account email and the assessment in question.

5. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable laws.
  • Share candidate data with unauthorized third parties.
  • Publicly disclose assessment links in a way that allows abuse (e.g. open Twitter/Reddit posts), beyond direct sharing with intended candidates.
  • Attempt to reverse-engineer, scrape, or extract source code, prompts, or generated questions from the Service.
  • Interfere with the integrity or performance of the Service, including bypassing rate limits or security measures.
  • Create accounts using automated means or false information.
  • Submit content that is illegal, defamatory, infringing, or harmful.

6. Intellectual Property

The Service, including its design, source code, prompts, and AI-generated content templates, is owned by ISMNS and protected by intellectual property laws. Assessment questions generated by the Service are provided for your use within the platform. You retain ownership of your job descriptions, candidate data, and any content you upload.

7. Candidate Data

As a recruiter, you are responsible for ensuring that you have the right to collect and process candidate data through the Service. You must comply with all applicable data protection laws (including the GDPR where applicable), including informing candidates about how their data will be used, the role of ISMNS as data processor, and our use of OpenAI to generate questions and evaluate responses. See our Privacy Policy for details on sub-processors and international transfers.

8. AI-Generated Content

The Service uses large language models (provided by OpenAI) to generate assessment questions and evaluate candidate responses. AI output may contain errors, inaccuracies, or biases. ISMNS provides tools to review and regenerate questions before publishing. Hiring decisions remain the sole responsibility of the recruiter. The Service is a decision support tool and is not intended to replace human judgment.

9. Limitation of Liability

The Service is provided “as is” and “as available” without warranties of any kind, express or implied. ISMNS shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of, or inability to use, the Service.

Our total liability for any claim shall not exceed the amount you paid to ISMNS in the 12 months preceding the claim.

10. Termination

You may stop using the Service at any time. We may suspend or terminate your access if you violate these Terms or for operational reasons (especially during the beta). Upon termination, your right to use the Service ceases immediately. Data retention is governed by our Privacy Policy.

11. Changes to Terms

We may update these Terms from time to time. If we make material changes, we will notify you via email or through the Service. Continued use after changes constitutes acceptance.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Wyoming, USA, without regard to its conflict of law provisions. Mandatory consumer protection rights under your local jurisdiction remain unaffected.
